• You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Site.

• You are responsible for ensuring that all information you provide on the Site is accurate and complete.

• If you create an account on the Site, you are responsible for maintaining the security of your account and password.

• You agree to accept responsibility for all activities that occur under your account or password.

• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Products and Pricing

• We strive to display accurate product descriptions, images, and prices on the Site. However, errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

• Organic Produce: Please note that organic fruits and vegetables are natural products and may vary in size, shape, color, and appearance from the images shown. Such variations are natural and do not constitute a defect.

• All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes (like GST) unless stated otherwise.

• Prices and availability of Products are subject to change without notice.

5. Orders and Payment

• Placing an order constitutes an offer to purchase the Products. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason.

• Order acceptance and the completion of the contract between you and us will take place on the dispatch of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it.

• We accept payments via methods listed on the checkout page (e.g., Credit/Debit Cards, Net Banking, UPI) processed through a secure third-party payment gateway.

• You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

6. Shipping and Delivery

• We currently deliver only within Siliguri city limits. (You can adjust this area later if needed).

• Delivery charges, if applicable, will be displayed during the checkout process.

• We aim to deliver Products within the estimated delivery times, but delays may occur due to traffic, weather, or unforeseen circumstances. We are not liable for any delays beyond our reasonable control.

• It is your responsibility to ensure that someone is available at the delivery address to receive the order during the specified delivery slot. Risk of loss and title for Products pass to you upon delivery.

7. Returns, Refunds, and Cancellations

• Perishable Goods: Due to the perishable nature of organic fruits and vegetables, we cannot accept returns for change of mind.

• Damaged or Incorrect Items: If you receive a damaged or incorrect Product, please contact us within 24 hours of delivery at hello@hrsingha.com with your order number and clear photographic evidence of the issue.

• Subject to verification, we may offer a replacement or refund for damaged or incorrect items at our sole discretion. We reserve the right to refuse refunds or replacements if the claim is not made within the specified timeframe or if sufficient proof is not provided.

• Natural variations in size, shape, or color of produce do not qualify as damage or defect.

• Orders can be cancelled only before they are dispatched. Please contact us immediately if you wish to cancel an order.

8. Intellectual Property

• The Service and its original content, features, and functionality are and will remain the exclusive property of HRS Store and its licensors. The Service is protected by copyright, trademark, and other laws of India. Our trademarks may not be used in connection with any product or service without our prior written consent.

9. Disclaimer of Warranties; Limitation of Liability

• We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

• The Products are provided ‘as is’ and ‘as available’ without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, quality, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the quality of any products will meet your specific expectations beyond being fresh and organic.

• In no case shall HRS Store, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of the service or any products procured using the service. Our liability shall be limited to the maximum extent permitted by law, and in no event shall exceed the total amount paid by you for the specific order giving rise to the claim.

10. Governing Law

• These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Siliguri, West Bengal.
